Welcome to GiveMeImages (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service lets you compare AI image generation across three upstream models (Nano-Banana 2, Nano-Banana Pro, GPT-Image-2). Anonymous users get one free comparison. Paid subscribers get higher-tier access per the plan they purchase.
2. Eligibility
You must be at least 13 years old (16 in the EU) to use the Service. By using the Service, you represent that you are old enough and have the legal capacity to enter this agreement.
3. Accounts
You may sign in with email, Google, or GitHub. You are responsible for keeping your credentials secure and for all activity under your account. Notify us immediately of any unauthorized access.
4. Acceptable Use — Prohibited Content
You agree not to use the Service to generate, request, or distribute any of the following. Violations may result in immediate account termination without refund and may be reported to law enforcement.
- Identifiable real people without consent — including living public figures, celebrities, politicians, athletes, and private individuals. This includes deepfakes, impersonation, defamatory depictions, and any image that could reasonably be mistaken for a real person.
- Copyrighted characters, IP, or brands — including but not limited to characters from Disney, Marvel, DC, Nintendo, Studio Ghibli, anime/manga properties, video games, films, novels, and any registered trademark or trade dress.
- Child sexual abuse material (CSAM) — any sexualized depiction of minors. We report violations to the National Center for Missing & Exploited Children (NCMEC).
- Non-consensual intimate imagery — “revenge porn”, upskirts, or sexualized content of any real person.
- Violence and gore — graphic injury, torture, gore, or content glorifying real-world violence.
- Hate speech — content attacking people based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
- Self-harm and suicide — content promoting, glorifying, or providing instructions for self-harm.
- Illegal goods or services — weapons, controlled substances, counterfeit currency, hacking tools.
- Fraud, scams, phishing — including fake IDs, fake invoices, fake brand assets used to deceive.
- Disinformation — fabricated images of news events, elections, or public figures intended to deceive.
- Spam, malware, or automated abuse — bot traffic, scraping, distributing the Service via wrappers.
We use automated and human review to enforce these rules. We may pre-screen prompts and block ones that match prohibited categories. False positives can be appealed to [email protected].
5. Ownership of Generated Content
Subject to your compliance with these Terms, you own the images you generate. We make no copyright claim on outputs. However, AI-generated images may not be eligible for copyright protection in every jurisdiction (e.g., the US Copyright Office currently does not grant copyright to purely AI-generated works). You are responsible for ensuring your use of any generated image complies with local law and third-party rights.
Free-tier outputs carry a visible watermark. Removing or obscuring the watermark from a free-tier image — including by editing, cropping, or running it through another tool — is prohibited.
6. Subscriptions and Billing
Paid plans renew automatically until you cancel. You authorize Stripe to charge your payment method at the start of each billing cycle. Prices are listed on the Pricing page and may be changed with 30 days’ notice.
Refunds are governed by our Refund Policy.
7. Service Availability
We aim for high uptime but do not guarantee uninterrupted service. Image generation depends on upstream model providers; outages or content-policy rejections from upstream are passed through. Failed generations do not consume your quota.
8. Indemnification
You agree to defend, indemnify, and hold harmless GiveMeImages and its operators against any claim arising from (a) your use of the Service in violation of these Terms, (b) content you generate or submit, or (c) your infringement of any third party’s rights.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT GENERATED IMAGES WILL BE FREE OF UPSTREAM POLICY REJECTION, ACCURATE TO YOUR PROMPT, OR FIT FOR ANY COMMERCIAL PURPOSE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
11. Termination
We may suspend or terminate your account immediately for any violation of these Terms, including (but not limited to) any prohibited content listed in Section 4. You may cancel your subscription anytime from the Account page.
12. DMCA
We respect intellectual property rights. To report copyright infringement, send a DMCA notice to [email protected]including the required elements under 17 U.S.C. § 512(c)(3).
13. Governing Law & Disputes
These Terms are governed by the laws of the State of California, USA. Disputes shall be resolved by binding arbitration in San Francisco, California, except that either party may bring an individual claim in small-claims court. You waive any right to participate in a class action.
14. Changes
We may update these Terms. We will email registered users 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.
